NON-SELECTIVE APPLICATION OF LAWS AND SANCTIONS FOR THOSE WHO DISOBEY THEM!

First, I wish to express regret that after almost three decades of independence of our country we are still discussing the topic of the rule of law as a precondition for doing business.

Why is the rule of law important to the business?!

In the market economy, as we tend to call ours, there are two key segments that make the rule of law imperative for the business:

1. The need for ensuring protection of property and

2. Guaranteeing implementation of the contracts between the entities.

The market economy rests upon the private property, which means that the law must protect the property by ensuring equal conditions for all and fair treatment, since only in such conditions the resources can be efficiently allocated and the owners motivated to work, increase their property, i.e. the capital, and with that to contribute to greater social wealth and better standard of living. Likewise, in order for the market to work, a guarantee is necessary that the contracts concluded between the economic entities will be implemented, which means providing foreseeability in the economic relations and decreasing the uncertainty of the investors that their contractual rights will be realized on time…
