 The Association of Civil Construction, Building Materials and Non-metal Industries on the session held on 11th March, 2014 discussed about the draft version of the Civil Code of the Republic of Macedonia - Book III-Obligation Relations.  Introductory notes to this exceptionally important document was presented by Gale Galev,Ph.D.,who emphasised that this kind of documents are passed once in hundred years, and that is why immense attention is dedicated to its preparation.  In the document care is taken about the equality and same rights, freedom and dispozition, ratio of transfer of rights and obligations and penalty.

 Special attention in the discussion was devoted to the part where the construction contracts are covered, for which introductory notes were given by Docent Darko Spasevski, Ph.D, who highlighted that when preparation the clauses are taken, which, unfortunately, are cancelled, than the FIDIC provisions- normatives and legal provisions that regulate the part of construction, financing etc. In his addressing several Articles were highlighted that are amended or deleted, but none of the Articles does not invoke some other Article from another Law, except some regulation.

 

 In the detailed discussion it was emphasised that there are enough clear provisions, system is good, terms clarified, and there will be no occurence of ambiguity in the interpretation. Some terms should be explained, i.e., incorporated such as for example:unpredictable works and unforeseen works, which are two different terms.
 As it was highlighted, the public discussion on the text of the Civil Code of the Republic of Macedonia - Book III- Obligation Relations, will last till 25th March, 2014, and untill this date all remarks, proposals should be submitted as amandments or suggestions to the Code Commission of the Civil Code, either single or as joint remarks through Economic Chamber of Macedonia.

 The President of the Association of Civil Construction, Building Materials and Non-metal Industries, Nikola Velkovski, expressing his gratitude for the detailled discussion of the representatives of the Commission and the members of Association, suggested to hold a meeting with the Association once again and to organize systematically all notes with suggestions and explenations and to submit them as mutual material through the Economic Chamber of Macedonia to the Code Commission of the Civil Code.
